Questions for Laws2050

Question 1: Martha Minow notes that religious leaders and psychologists acknowledge that forgiveness is a force for good, but still it remains complicated to incorporate forgiveness into justice and law (2019, p. 34). What role does forgiveness play in restorative justice? Illustrate your answer by referring to one example of a restorative justice process explored in this unit.
[For the purposes of this question, you may consider a restorative justice process to include examples of restorative justice processes, reintegrative shaming processes, responsive regulation processes, and/or transitional justice processes studied in this unit. For example, the Childrens Court – the Children’s Court dealing with young offenders. The Children’s Court recognises that children can commit serious crimes, but that they should be dealt with differently than adults. We will consider the arguments that techniques of RJ and reintegrative shaming are most effective with children.
One of the innovative ways criminologists have responded to the failings of criminal justice and in particular, the emotional needs of victims and the general community – Restorative Justice or RJ.
RJ is an alternative to criminal justice (or sometimes an adjunct) which aims to be more victim-centred, invoke a sense of moral responsibility in offenders, provide for restoration of wrongdoing and reintegration of offenders. Some people who have never been involved in RJ imagine it is a “soft option”, however those who have participated in RJ tend to describe it as gruelling, highly confronting and life-changing.  MUST INCLUDE JOHN BRAITHEWAITE PERSPECTIVE ON RESTORATIVE JUSTICE ]
